Terms of Use of N&W Professional Traders Services.

Please read carefully the Terms of Use of the Services of the digital platform www.nwprofessionaltraders.com (the “Platform”), referring to the institute that offers financial education courses (“N&W”), which are detailed below, since they contain information of interest to you related to the use of the service. By accessing the Platform, the user agrees to comply with and accept all the terms and conditions that appear below. This document constitutes the instrument that will contemplate the Terms of Use of the services of the Platform that will be applied and will be mandatory for all users who wish to acquire courses, training and/or use the web platform www.nwprofessionaltraders.com.

If you do not agree with these Terms of Use, we advise you not to access the Platform. N&W Professional Traders S.R.L. – Av. Cabildo, 3073, 11th floor, Department “B”, Autonomous City of Buenos Aires, Argentina – C.P.: 1429.

COOKIES

The user of the Platform knows and accepts that N&W uses third-party “cookies” that allow obtaining data linked to the preferences of its visitors from which no identifying data is extracted, aware that it is only a technical resource to improve the experience to navigate it, enabling the visitor, on their own and third-party sites, to display advertising, promotions, banners and commercial initiatives. We also use cookies to personalize the experience and content of the site and adapt our offer of courses and training. Cookies are text files sent by a website that are stored in the visitor’s browser.

The Terms and Conditions can be modified at any time and without prior notice, so the user must access them frequently in order to verify them. The use of the Platform and/or the registration for any course and/or training will imply the acceptance of those present.

Definitions

Services: The services achieved by this document include:

  1. Virtual platform, including access to the material of each course to all users; access to their grades; access to the registration of their attendance; access to the registration of payment of fees.
  2. Access to the online course or training and its content.

User: Anyone who participates in N&W courses and/or training, including students, tutors, coordinators and teachers.

Supplier: N&W

Necessary data: first name; last name; e-mail; phone number; country of residence; ID.

Scope

N&W will provide the services to all users. N&W will arbitrate the means at its disposal to provide the best service available and with the technology that, according to its resources and technical-economic possibilities, is considered appropriate. N&W reserves the right to change the way it provides the services, pledging to inform users as far in advance as possible.

Terms of Use

N&W may withdraw or suspend, prudently, the provision of the service to those Users who do not comply with the provisions of these Terms of Use of the services, reserving the corresponding legal rights against any damages that such breaches cause them.

Responsibilities of the User

The User undertakes to use the service in accordance with current legislation, morality, good customs and public order, as well as to refrain from using the service for illicit purposes or effects, prohibited in these Terms of Use of the services, harmful to the rights and interests of third parties, or that in any way may damage, disable, overload or deteriorate the services, computer equipment of other users or other Internet users (hardware and software) as well as documents, files and all kinds of content stored in their computer equipment (hacking), or prevent the normal use or enjoyment of such services, computer equipment and documents, files and content by other users and other users.

Security and Privacy

The user gives his informed consent to the following issues:

  • Access to the user’s information is restricted to the user himself through the use of his password.
  • N&W reserves the right to share the necessary data with entities related to the topics taught in the courses, for example in the context of job searches, taking into account the best interest of the students.
  • N&W will not sell any type of information to external entities or use student data for advertising purposes. You will only use data for authorized educational purposes.

TRADEMARK, ADVERTISING AND INTELLECTUAL PROPERTY RIGHTS

All elements, including images, texts, illustrations, icons, logo and isotypes, photographs, programs, animations, any music, melody, video clip and any other element that is part of the website or the training provided by N&W are protected by the intellectual property rights of N&W, and any reproduction, modification or distribution thereof is prohibited.

Likewise, all comments from third parties that are published on the Platform or that are issued during the completion of a course and/or training, will be the sole responsibility of their authors, exempting them from total responsibility to N&W, and obliging themselves to keep it free from any action and/or claim that it may receive as a result of them.

CONFIDENTIALITY

The student, when hiring the N&W services, fully understands that all the material and information provided in the courses is confidential and under this the obligations of secrecy and reservation in this regard govern, not being able to disseminate or disseminate for his own or others’ benefit for any reason or means (digital or non-digital) the information and material provided to the student throughout the course. At any event, “Confidential Information” includes, individually and/or collectively, all information provided by N&W in the development of the training, including, but not limited to: (i) concepts, techniques, principles and other concepts underlying its computer systems and applications to which you may have access as a result of your participation in the trainings, as well as all other data and information, analysis, studies, notes, compilations, summaries, memos, reports and conclusions or any other document prepared by N&W; (ii) any type of information related to the operation of N&W and its infrastructure, hardware, software, data, students, communications and computer security.

The student expressly acknowledges the confidential nature of all Confidential Information provided by N&W and the fact that it is their exclusive property. Consequently, the student accepts and agrees that he will not allow access to Confidential Information or disclose, in part or in total, its content to any third party, without the prior written or oral consent of N&W.

It is excluded from the effects of this manifestation that information subject to confidentiality and reservation that: (i) at the time of being disclosed is already in the public domain, or that, after said disclosure, becomes in the public domain for reasons not attributable to the student, for which, it will be understood that the information that appears in a source of dissemination freely accessible to the general public is understood to be in the public domain; (ii) that the student has obtained it without being obliged to keep it in reserve, from a source other than N&W and without said source being unaware of or violating a pact of reservation or confidentiality; (iii) its advertising is required in accordance with the laws in force or by virtue of a written order of the competent authority, an event in which the student will immediately communicate this situation in writing to N&W so that it can take the necessary measures to oppose said request by advancing the judicial or administrative actions that are the case, collaborating with it in everything that is at its disposal to safeguard, protect and maintain the reservation of said Confidential Information; and (iv) the one that expressly authorizes the disclosure of N&W.

The student understands that the violation or breach of the obligation of confidentiality, may be left in the crime of violation of secrecy typified in Article 156 of the Criminal Code of the Nation of the Argentine Republic, with the power of N&W to formulate the complaint, criminal or administrative, of the case and constitute a plaintiff as well as claim for the damages caused.

REGISTRATION FOR THE COURSES

The following Terms of Use apply without exception to any student who enrolls in the courses and trainings taught by N&W. It is the responsibility of the registrant to inform themselves about the terms and conditions of the service and the use of it, as well as the use of the services offered implies their acceptance. N&W reserves the right to suspend a student if, in its sole and exclusive opinion, it does not comply with the provisions of the terms and conditions and/or commits or is suspected of committing any activity that could violate the rights of N&W. The user will not have the right to any type of action and/or claim in this regard, hereby renouncing to make them.

IMPORTANT: The courses/training courses are transferable as long as the course has not started and is notified at least 5 (five) working days in advance.

REGISTRATION PROCESS

In all cases, it must be done via the web at www.nwprofessionaltraders.com or by contacting a representative, either via email (info@nwprofessionaltraders.com) or WhatsApp (+54 9 11 7365 6986). The user must complete the corresponding registration and select the dates and times that fit his responsibility as long as there are vacancies, make the advance payment of the entire course, using the different payment platforms available for this purpose.

Limited spaces: The quotas for the courses are limited. The quota for the course is confirmed and reserved only having made the payment of the same by any of the means authorized for that purpose. The quota of the course will be closed when the vacancies of the course are completed.

Modifications: N&W reserves the right to reschedule and/or cancel the courses as it provides. In the case of cancellations or modifications, students who have already paid it, may choose to use the balance in another course of their interest or transfer it to another person.

N&W also reserves the right to change teachers or tutors due to their personal problems, poor performance within our courses or behavior.

Finally, N&W reserves the right to modify the start date of the course with prior notice to students due to lack of teacher assignment or modifications to the content.

These types of changes will be notified through any of the means of communication that N&W has with its students.

Coupons and promotions

The discount coupons corresponding to promotions that N&W provides to people who want to register, will only be valid in institute courses.

Request for Invoices

Invoice A orders are made exclusively at the end of the registration process, providing the following information:

  • Business name
  • CUIT
  • VAT status
  • Address

The invoices issued are type “B” for final consumers and single taxpayers and “A” for responsible persons registered in VAT. The latter must send the billing information and take about ten (10) business days once the order is placed, sending it directly to the applicant’s email. The student must request this type of billing at the email box info@nwprofessionaltraders.com.

IMPORTANT: If the student uses a MAC computer (Apple), he will have to operate with the BingX platform, or use a virtual machine that may involve an extra cost.

Certificates

The certificates corresponding to the completion of the courses will be issued only after completing the course and having met the aforementioned requirements. To request the certificate of approval corresponding to a training, the student must request it by sending an email to info@nwprofessionaltraders.com.

Refunds of payments

N&W will make refunds of payments only in case of cancellation and non-rescheduling of the contracted training. In no other case may the refund of the payment corresponding to the training be requested. The student must request such a refund by emailing info@nwprofessionaltraders.com. In case of not proceeding to request the refund of the money, the student may choose to leave the balance in favor of the training not carried out to be able to use it in the acquisition of any N&W course within one year. The student will also be able to transfer this balance to a friend or family member. If applicable, the return will be made within a maximum period of ten (10) working days and from the means of payment determined by N&W.

CODE OF CONDUCT

From N&W we want to promote a space conducive to learning and free of distractions. Behaviors that are harmful to the well-being or safety of other students, teachers, tutors and/or N&W team will be considered inappropriate. The following situations will give rise to a warning from N&W, with the possibility of withdrawing the student from any course, without the possibility of claiming the subsequent refund of his money:

  • Behaviors or threats of violent behavior towards students, teachers, tutors and/or N&W team will not be tolerated
  • Disrespect or verbal abuse of students, teachers, tutors and/or N&W team will not be tolerated.
  • The falsification, alteration or improper use of documents, material or information from N&W will not be tolerated.
  • The use of the service to transmit, display or make available messages, content or material that are illegal, obscene, threatening, defamatory, privacy invaders or that violate or infringe copyrights, trademarks, patents, trade secrets and other intellectual property rights will not be tolerated.
  • The use of any internal communication channel of the platform for non-educational purposes or actions other than what was communicated by the N&W team when creating any of these will not be tolerated. In case of observing any behavior that may alter the common order of these channels, the student will be warned and in case of not changing his attitude, he will be removed from the internal channel immediately.

During the courses, students are expected to behave in an appropriate and respectful way, taking into account a high standard of education towards other people. Any violation of the provisions herein will be subject to the review and the relevant actions that N&W decides to take for its consideration, including proceeding to the right to terminate the service. The company reserves the right of admission and permanence.

ADDRESS, APPLICABLE LAW AND JURISDICTION

The legal address of N&W is Av. Cabildo 3073, 11th floor, Department “B”, Autonomous City of Buenos Aires, Argentina. These Terms of Use of the Service have been drafted and must be interpreted in accordance with the laws of the Argentine Republic. You agree that any dispute, conflict or divergence that may arise from the use of the Platform and the Terms of Use will be subject to the jurisdiction of the Ordinary National Courts based in the Autonomous City of Buenos Aires, excluding any other jurisdiction or jurisdiction that may correspond.
